QS Terms of Service

These Terms of Service govern your access to and use of QS, including all theme files, documentation, updates, and related digital products provided by QS.

By purchasing, downloading, accessing, or using QS, you agree to be bound by these Terms of Service. If you do not agree, do not purchase or use QS.

1. About QS

QS is a premium Shopify theme provided as a digital product. QS is intended for use on Shopify stores and includes design, code, and supporting documentation.

2. Digital Delivery

QS is delivered electronically.

Once your purchase is confirmed, access to the theme files and associated materials is provided digitally. You are responsible for ensuring you have the ability to access and install the theme on Shopify.

3. License and Usage

QS is licensed, not sold.

Your purchase grants you a limited, non-exclusive, non-transferable license to use QS in accordance with our License Policy.

Each purchase is valid for one Shopify store unless otherwise stated.

4. Payments and Pricing

All prices are listed in the currency shown at checkout.

By completing a purchase, you agree to pay the full amount, including any applicable taxes or fees charged by the payment provider or required by your local jurisdiction.

We reserve the right to change pricing at any time. Price changes do not affect purchases already completed.

5. Refunds and Returns

Because QS is a digital product, refunds are generally not offered once access has been provided.

Refund requests are assessed in accordance with our Return and Refund Policy.

6. Support

Support may be provided for QS at our discretion, including guidance for installation and standard theme setup.

Support does not include:

  • Custom development work

  • Custom design services

  • App troubleshooting or third party service troubleshooting

  • Fixes for issues caused by code modifications, external scripts, or unsupported changes

We reserve the right to refuse support if the theme has been heavily modified or used outside the intended license terms.

7. Theme Updates

We may release updates, patches, improvements, or feature additions to QS.

Updates may be provided at no cost or as part of a paid upgrade, depending on the nature of the update. We are not obligated to provide updates indefinitely.

8. Intellectual Property

All QS theme files, code, designs, documentation, and associated materials remain the intellectual property of QS.

You may not copy, redistribute, resell, sublicense, or publish QS or any part of it outside the scope of your license.

9. Prohibited Use

You agree not to:

  • Share, distribute, or resell QS theme files

  • Use QS on multiple Shopify stores under one license

  • Remove or alter copyright notices

  • Claim QS as your own work or product

  • Use QS in a way that violates applicable laws or Shopify’s policies

10. Third Party Services

QS may be used alongside third party apps, integrations, and services.

We are not responsible for the performance, availability, compatibility, or security of third party services.

11. Limitation of Liability

To the maximum extent permitted by law, QS and its creators are not liable for any indirect, incidental, special, or consequential damages, including but not limited to:

  • loss of profits

  • loss of revenue

  • loss of business

  • loss of data

  • business interruption

QS is provided on an as-is and as-available basis.

12. No Guarantees

We do not guarantee that QS will:

  • meet every business requirement

  • work with every third party app

  • remain compatible with future Shopify platform changes without modification

  • produce specific sales, conversion rates, or business outcomes

13. Customer Responsibility

You are responsible for:

  • backing up your theme before making changes

  • ensuring Shopify store settings are configured correctly

  • ensuring any installed apps or scripts do not conflict with theme functionality

  • testing changes before publishing to a live store

14. Termination

We reserve the right to terminate access or support if:

  • license terms are violated

  • QS files are redistributed or resold

  • fraudulent activity is suspected

If your license is terminated, you must stop using QS and remove it from all Shopify stores.

15. Worldwide Customers and Consumer Rights

These Terms apply worldwide.

Nothing in these Terms limits any consumer rights that cannot legally be excluded under the laws of your country or region.

16. Changes to These Terms

We may update these Terms of Service at any time.

The version in effect at the time of purchase will apply to your purchase, unless required otherwise by law.
